Sixth Amendment
There isn't any specific mention of 'free' trial in the US Constitution, but it has been inferred from the statements that everyone is entitled to have defense counsel. In order to insure that, the legal system has been forced to provide legal representation for those that cannot afford it.
Sixth Amendment ? Trial by jury and other rights of the accused. In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district where in the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.
There is no guarantee to a free and public trial. You are guaranteed a speedy trial, being judged by a jury of your peers, and the right to confront your accuser. The right of an attorney being provided free of charge is not in the Constitution.
