The heart of our rights as human beings is said as "The rights to life, liberty and the pursuit of happiness." {Notice that's PURSUIT not actual having happiness.} The Constitutional Amendments generated by the US Second Congress to meet the above statement included mainly ways to keep our government from abusing it's constituents and from one constituent from abusing another.
1 - (a) Right to free speech: the ability to have and say your own opinion in your own home. This also extends somewhat to public spaces. As long as the speech is not 'disrupting' of society as a whole and is not obscene, lewd or slanderous then it is protected.
(b) Right to live your religion uninterfered in by government.
(c) Right to free speech via press
2 - Right to bear arms for 2 reasons - (a) to be able to serve as part of a local Militia to defend town or city AND (b) for personal protection from other people who would attempt to that the right of life away.
3- Army cannot force a homeowner to give them free room and board (this often happened during war before now and it could bankrupt and/or destroy honest citizens' unfairly)
4 - Right to be free of unreasonable seizure and search: Policeman "I want to search your house just to check if you have stolen goods." Owner "Why would you think that?" Policeman "I don't have to, no need for any reason, I'm the law." And keeps the government from just seizing your property just willy-nilly "We're making a new road going right through your house, you need to move." "But I don't have the money to buy a new house!!"
5 - (a) Right to keep quiet about bad things you've done; that is, you cannot be compelled to tell on yourself.
(b) Right to due process: the executive branch (law enforcement) must do the same paperwork and work up on everyone, no freebies.
(c) Sets rules for arrest, indictment and conviction
(d) sets rule of double jeopardy, you cannot be charged 2x for the same crime.
6 - (a) Speedy trial (law can't hold you for 40 years waiting for a courtroom)
(b) right to trial by impartial jury and not just by judge
(c) that the accused be able to face their accusers (someone can't be a witness and not be known by defense) - this is to keep down false accusations
(d) accused has a right to a lawyer
7 - Guarantees trial by jury in federal civil court cases
8 - Punishments for law breaking be fair and outlandish fines not be set: you can't get 20 years in jail for spitting on the sidewalk.
9 - Is an open note that these proclamations may not cover everything clearly but that doesn't prove these other rights don't exist.
10 - Any power not conferred to US Government is passed on to the states themselves.
Our system of law is about this " Your rights to do something end at the edge of my nose" That is,you have the freedom to do these things AS LONG AS you do not impinge on my rights to do the same.
