Fair use can be claimed when a passage is copied from an author's published works, and is used by someone else as an example, or to make a point, or to cause a discussion. The fair use is used to prevent an infringement of Copy Right Laws, but the passage used must be brief, to the point, and the original author must be acknowledged.

The examples listed in the US copyright law are "criticism, comment, news reporting, teaching, scholarship, and research," but you'll find that most copyright lawyers like to point out the list is preceded by the words "such as."

In addition, criticism, comment, news reporting, teaching, scholarship, and research are not automatically guaranteed to be fair use, and cases exist where uses have been found not to be fair. You would need to consider the list of examples, the four factors, and the notion of transformativeness before deciding a use is fair, and even then be prepared to defend your decision in court.

Quoting a book in a review, copying an article out of an encyclopedia for personal study, and playing musical examples in a classroom are all common examples of fair use.
