That is not correct. After 5 years, if there were no aggravating circumstances and no other offenses in that period of time you may apply to the court to have the charge expunged from your criminal record. The charge is automatically off your driving record after 5 years. I confirmed this information with an attorney.

Those are non expungable. If you was convicted of it then its stuck on their. Even when you wasnt convicted, its still hard to get it expunged because states really frown on dui. But you can always still try
