It shouldn't matter who was driving. The insurance company is responsible for the VEHICLE not the driver.

Will the police force you to pay the other driver? Who is charged when a friend is driving a friends car and wrecks it? Can you sue the owner of a vehicle that hit you but someone else is driving?
