It shouldn't matter who was driving. The insurance company is responsible for the VEHICLE not the driver.

Will the police force you to pay the other driver?  Who is charged when a friend is driving a friends car and wrecks it?  Can you sue the owner of a vehicle that hit you but someone else is driving?  What if you are hit by another driver you get their plate the police charge them and the insurance will not pay for the damage to my car because the other driver says a friend was driving the vehicle?  Will the insurance company share information with police department about who was driving in a supposed hit and run?
