The minor may leave the relative's home and return to the residence of the mother whenever she so chooses. This however would not apply if the uncle has temporary or permanent legal guardianship of the minor or some other form of custodial order has been issued by a court.

You are seventeen years old and your mom lost custody of you and you live with your uncle because he has custody of you and want to move back in with your mother what do you do?

Go get help from Social Services and tell them that you want to be back with your mum. There may be a good reason why you were put with your uncle so you would need to find out this but anyway when you reach 18 you can do what you like.

Can parents get a 16 year old back if living for 2 years with the grandmother and the teenager does not want to move back with the parents?

The 16yo is a minor and unless she is emancipated she can not decide where to live. If the grandmother have custody you have to go to court to get her back but if you still have custody the grandmother have no right to keep her.

Can you send your 16 year old son from Milwaukee wi to live with his uncle in Mississippi without going to court?

The only reason to go to court would be if the parent is transferring legal guardianship or custody to the uncle. Parents send their children to live with relatives for the summer and for other various reasons and there is not an issue. However, if the child is to live with a relative indefinitely, the parent will still make all medical and schooling decisions until custody is transferred by the courts.

Can a child move back in with his mother if his uncle has sole legal custody of the child and is willing to let him go live with her and if so will the uncle be responsible if something were to happen?

Yes, the uncle would be responsible if something were to happen. Also, if custody was taken from the mother involuntarily the uncle could find himself in trouble for returning the child to his mother. He could be charged with child endangerment. The parties must return to court and request that legal custody be returned to the mother. They should consult with an attorney who specializes in custody issues if the situation is complicated.Yes, the uncle would be responsible if something were to happen. If your dad sent you to live somewhere else does that mean he still has custody of you?

If you live in the US... Yes, Dad still has custody, unless he has voluntarily given legal custody to someone else or the court has awarded legal custody to someone else (normally only happens in cases where the parent has been proven to be unfit).

Do you still have custody of your niece if you never signed back to her parents?

That depends on where you live and your custody order. Were you granted temporary custody with parental rights intact? Were the parents divested of their parental rights and you were granted sole legal and physical custody? There are all different kinds of custody agreements and they can be modified. Refer to your documents or seek the advice of an attorney for an informed opinion.

I live in Texas and my 16 year old and my 13 year old lives in Louisiana with their uncle. How old do they do they have to be to legally be able to say where they want to live?

They can not decide until they are 18. When they are around 16 the court might ask for what they want if you ask for custody. They are however not obligated to follow that wish. I wonder why they live with their uncle and not one of their parents. If you were found unfit it is still not certain the court would let them go live with you now unless you have changed and can prove it.

Im the father and you live in IL The mother lives in TX your son lives with you If you have joint custody but you have residential custody can you the father still get child support?

yes

Do you have custody if children live with you?

Depends on the circumstances. If you are a single father, without court orders, the mother still has sole custody and control. If married, you have possession, however if you file for child support, you have a presumption of custody.
