If you are allowed access to the iPod by the seller, copy down the serial number and take it to your local police agency and ask them to check the serial number for stolen. Many (most?) departments will do this as a public service. Of course, if it turns up as stolen you are going to be asked by them where the item is and who is selling it, and you will have to answer. If the deal is too good to be true, smell a rat!
You can not, in anyway, disable your ipod once it has been stolen.
