The discipline given to a Roman soldier depended upon his "crime". A centurion carried a vine stick as one of the symbols of his office and was free to use it to thrash any legionary for minor infringements. For more serious breach of rules, such as insubordination, a man could be made to stand outside an officer's tent with his tunic unbelted and holding a wooden beam or a roll of sod in front of him. It is said that this was a punishment favored by Augustus. Of course there was always good old fashioned flogging for a wayward soldier. For more serious infringements, a court marshal was held and legionaries found guilty could be sentenced to death. This could be by beheading, flogging or in rare cases crucifixion, as a Roman soldier, although required to be a citizen, gave up certain rights of citizenship when he joined the army. According to the ancient writer, Polybius,
crimes that earned the death penalty were: stealing goods in camp, giving false evidence, Homosexual offences committed by those in full manhood, and for lesser crimes where the offender had been punished three times for the same offense. Falling asleep on guard duty, making a false report about their courage in battle in order to get a reward, men who deserted their post and men who threw away their weapons out of fear on the battlefield were also executed.
If entire units were involved in desertion or cowardice, they could be sentenced to decimation: reduction by one tenth. The guilty men would draw lots. One in ten would have to die with the execution being carried out by the other nine. Decimation sentences were carried out by clubs, swords or flogging depending upon the commanding officer. The survivors of a decimated unit could be put on barley rations and made to sleep outside of the camp walls with no protection against night attack.
