Under the United States Constitution, the government may do something which may later be declared unconstitutional by the courts. If the government continues to ignore the decision of the court, then the government is acting in an unconstitutional way. If a military coup takes over control of a government and does away with the current constitution, without the consent of the people, it is acting as an unconstitutional government.
