In general, parental rights are terminated either preparatory to an adoption, or after a trial in which it is determined that the parent is unfit. In any case, termination of parental rights does not, in itself, terminate child support.

Can a parent give up parental rights to a child even if parents are still married to each other?

A biological parent is automatically the legal guardian of his or her minor child unless they voluntarily relinquish parental rights or the court terminates those rights to their child. Temporary custodial/visitation/support issues are decided at the time divorce papers are filed, the permanent decisions are finalized at the time the divorce decree is granted.

Can a father act Pro Se to relinquish parental rights to his daughter after an uncontested divorce has been filed?

You cannot give up parental rights unless both parties agree. You will have to pay child support if she wants you to. * Either parent may file for termination of parental rights in the appropriate state court, that usually would be a circuit court. Contact the clerk or court administrator of the circuit court in the city or county of residence for specific information. Termination of parental rights is usually allowed when it is in the best interest of the child and/or to allow a child to become eligible for adoption. Any interested party including another biological parent may contest the TPR petition if they so choose.

Can father relinquish parental rights AZ?

Yes. Such an action must be filed in the court of jurisdiction (where the child legally resides). However termination of parental rights does not automatically terminate child support obligations. This usually happens only if the child is being adopted. All that termination of rights will accomplish is ending the right to see their child or have any say-so in their lives.

Just my opinion. I believe that if there is no court ordered parental custody or neither parent has filed for total custodym then either parent has the right to the child until otherwise ordered by a judge.
