Any child born on U.S. soil is a natural citizen of the U.S. The mother/father does not attain citizenship merely because of the birth. If they were illegally in the U.S. at the time of the birth, they are still considered "Illegal" and are subject to deportation.

AnswerIf the child is born in America, he or she is legally an American citizen. If the parent is deported, the child has to have a financial sponsor. AnswerThen, That American-born child can file Immigration papers for his/her parents when he/she is 21 years old. It is a long wait, but right now it seems that it's the only way for the parents to become legal immigrants.

There are only 2 choices: 1) take the baby with you to your home country or 2) surrender the baby to authorities. Most illegals make a big stink when they are about to be deported, claiming that they would rather give up the baby before taking the child with them; but most of them do take the child with them.

The notion that an anchor baby can prevent the mother's/father's deportation is a myth.

I'm no expert on immigration law, but I do believe it is good grounds for citizenship, but there's always a chance he'll get deported. the child is a legal U.S. citizen
