What happens if there's a wreck with a fatality and both drivers had same insurance company?

The insurance company's claims dept will likely set up two separate claims and investigate them independently and then come to a conclusion as to liability/fault. Assuming it is 100% one or the others fault then that policy will pay for the damages, during the investigation each may make a claim and pay for damages under their own policys then once liablity has been established, the ''guilty'' one will ''pay back'' the innocent.
