I don't know what prompted you to ask this question.
I think that just asking the question will alter your relationship.
why would he ask you out if he is gay?
He might take it as a compliment that he appears to be 'in touch' with his caring, sharing side.
He might be offended that you should think he is gay.
He might be upset that you listen to gossip.
If he is gay he might be relieved that it is out in the open in which case you can no longer be girlfriend/boyfriend but you can be a really good friend and help him to 'come out' to the rest of the world.

The answer above is correct that you should use a condom, but straight people are more likely to have HIV than gay people these days anyway, so his sexuality doesn't affect that. Of course, your relationship might not be suxual anyway, so it could be irrelevant.
