Depends, why are they asking you to submit to a drug test? If it's just a random test for no reason, there's not much they can do. However, if there is a history of neglect or abuse then they have the power to petition the court for custody of ALL of the children in your home.

∙ 12y agoIt depends on the allegations, and what drug you were positive for. It also matters what state you are in. If you test positive for Marijuana you will not have your children removed. Anything else and the circumstances, state, and allegations as well as the age of your children are a factor.

∙ 12y agoYou will be held responsible for the test the same as if you were guilty as refusing a test the judge will assume the only reason to refuse is that you will show up positive is there really any other reason to refuse

Refusing is worse than failing and what you are trying to avoid is about to happen if you refuse.
