Terms of your settlement will be worked out with the lawyers, both the plaintiffs and defendants, or through the courts. If the case is settled out of court you are far more likely to receive money quickly than if the case is decided by a judge or jury. In these cases there are often long and complicated appeals which can tie up verdicts for years.

In most cases, you will not have to pay taxes on the main portion of lawsuit settlements. The idea is that it would be too confusing if the monetary number to be awarded would end up being less than-say-the value of the medical bills. However, additional funds such as punitive fees assigned by the court and interest accrued on compensations may be taxed. The attached law article explains taxing and lawsuit settlements in more detail.
When any party to a lawsuit dies, the estate of the deceased party is substituted for the person. The estate executor or administrator then becomes the party in interest to handle the lawsuit. In most states, the executor/administrator will handle the lawsuit without having to consult with the ultimate beneficiaries before taking any action, such as settling. In practice though it is wise to get some feeling from the beneficiaries, since they might make some objections about a settlement and try to hold the executor/administrator liable for making a bad settlement. But once the ececutor/administrator does sign on the settlement, the beneficiaries cannot re-open the case just because they dislike the result.
