Encumber, is to impede, hamper or burden someone or something.
Encumberance, something that is an impediment or burden.
Incumbent, can mean the holder of an office; or: of being imposed upon somebody as their duty or obligation. (As in It is incumbent upon you to do the right thing.)

You are not innocent until proven guilty but rather presumed innocent. In a legal sense this means that the it is encumbent upon the prosecution to prove your guilt and not encumbent upon you to prove your innocence. The arrest is made because there is a reasonable presumption of guilt but you are only sent to jail if the court is convinced you pose a flight risk. These matters seem to contradict a presumption of innocence but a declaration of freedom for all followed by the creation of a government to ensure justice is a contradiction as well. It is why the people have come together to form a more perfect union rather than a perfect union.

Yes, you can have restrictions placed on your driving privilege by the court. If you have a number of unpaid traffic tickets, you are a "persistent abuser" of the codes, both by continuing to get the tickets and also by not paying them off. Regardless of your excuse. By the way, if you simply don't make enough money, it is still encumbent on you to contact the court and make some kind of arrangements before the problem escalates and you find that a bench warrant has been issued for you.
