This is a frequently described situation. Again, there are a LOT of variables-- The maturity level of both; the present relationship between the two; the girls relationship with her parents or guardian; the 20 year old guy's relationship with the girls parents; whether the conception was coerced or consensual; the specific laws of your state; and other issues. TECHNICALLY, because the girl is under the age of CONSENT, it would be considered STATUATORY RAPE in the eyes of the law. IF anyone involved is NOT pressing charges, and the state and law enforcement is not contacted/involved, then the male won't neccessarily be prosecuted. HOWEVER, whatever the situation is, the male has a legal responsibility to financially support the child until the child is 18 years old. If the father refuses to pay support, the mother of the child can then petition the courts for support and proceed with prosecution of the father. If the girl is in fact pregnant, it's VERY IMPORTANT for her to get pre-natal care. She could visit the local PLANNED PARENTHOOD (NO,it's not an abortion mill) and receive check-ups, pre-natal vitamins, and get counselling in a confidential manner. I believe they charge based on your income level. I hope everythhing works out well for all involved. Also, I hope this answers your question! (P.S. If you continue sexual contact, I HOPE you both use Birth Control----AVAILABLE AT PLANNED PARENTHOOD). Lock him up!
Normally she will have a baby. It is not illegal for a 20 year old to have sexual relations with a 17 year old as long as 16 or 17 is the age of consent where they live. Otherwise it could be statutory rape. That doesn't mean however that he is not partially responsible (by law) for the maintenance and upkeep of the child.
The answer to this question depends significantly on the laws of the state where the impregnation and birth occur.
The most plausible consequence under criminal law is that the 21-year-old male could be charged with statutory rape. It is unlawful to have carnal knowledge of a female under the age of consent, even if the female willingly participated or the male was reasonably mistaken as to the female's age. The particular age of consent depends on the state where the carnal knowledge occurred, and in most states the age of consent ranges from 16 to 18. Several states allow a reasonable mistake as to the female's age to prevent conviction, but the standard for showing reasonable mistake is fairly high.
If the 16yo has not yet reached the age of consent in her state and there are no close in age exemptions to the law, he can go to prison for statutory rape. She is the only one deciding whether to keep the baby or to have an abortion. Having a baby does not emancipate her apart from making decisions for the baby and medical decisions for herself. She is still a minor and have to do what her parents tell her to do. If they don't want her to see him they can get a restraining order. he will still be allowed to see his child though unless he gets sentenced for statutory rape. Also, if she is below the age of consent the pregnancy is not a free card to have sex just because they are now pregnant. It would still be illegal until she reaches the age for consent. So it depends on where you live and how your parents take it.
In short, not a lot.
This does kind of depend on your local legislature, but in the majority of the western world the age of consent for sexual relationships exists because the law considers that under a certain age a young person is not fully equipped to properly consider the potential impact on their lives of a sexual relationship.
The Law generally states that under the age of consent a girl isn't able to give consent to a sexual relationship.
Usually if somebody who is over the age for criminal responsibility (in this case the 20 y/o male) has sex with a person who is under the age of consent (the 15 year old girl) it is the 20 year old who is committing an offence.
Usually statutory rape or something similar.
The girl is usually seen by the legislature as a victim of the crime, as apposed to a perpetrator.
Note:
There's also the chance that, in nine months time, the girl will give birth to a child.
your partner could be charged with statetory rape because you are still considered a minor, but probably wouldn't happen if your parents don't press the issue.
It will depend upon the states or country. In most places the legal age to consent to sex is 16. In some places it is 17 or 18, so check your local laws.
the 18 year old CAN go to jail if the 16 year olds parents press charges on the 18 year old
then either way your screwed
Then he's lucky!
