The legal definition of spousal abandonment is defined when one spouse leaves without consent, and remains away from the other spouse without any type of emotional, physical or financial communication for a designated period of time. Depending on the state, other stipulations such as whether or not the complainant contributed to the spouse's departure, if no child support has been paid, or the spouse has been away for more than a year, may also be required.
