Sometimes a fence is the best thing to make good neighbors. I would start by finding the property pins and build at least 6 inches off the property line on your side. Use a string line to make sure its straight. I would give the neighbor the ugly side, or the side that shows the posts and verticals. The reason for this is, if you have to renail the wood, you can do it from your yard. To be a great neighbor, build a gate so the neighbors wont feel totally shut out and can visit at their choosing.

Not if the fence is on their property. It would have to run right along the proerty line and be considered a joint fence. However, if you ask your neighbor whether they mind you adding a little beauty to the yard, they probably wouldn't mind.
