There is no "law" passed specifically to authorize body scanners. The Homeland Security Act, which was the enabling legislation for the Department of Homeland Security, is the basis under which that Cabinet level department operates.
Is there a circumstance under which the Department of Homeland Security would ever take the threat level to blue or green?
I can't imagine such a thing. Politically, this would be someone saying "it's all safe now...". If anything happens at that time, their career is dead at the very least. Maintaining a higher level avoids this problem.
