The Director of Homeland Security comes to work in the morning and says, "It feels like an elevated threat today." Truthfully there's no set criteria for the Advisory System and the best action to take if the threat level is ever elevated is to tuck your head in between your legs and pray. Unless you're an atheist, then in lieu of praying you would just hope luck is on your side.

There is no "law" passed specifically to authorize body scanners. The Homeland Security Act, which was the enabling legislation for the Department of Homeland Security, is the basis under which that Cabinet level department operates.
I can't imagine such a thing. Politically, this would be someone saying "it's all safe now...". If anything happens at that time, their career is dead at the very least. Maintaining a higher level avoids this problem.
