Recording your inbound and out bound phone calls that you personally make is legal, but remember you can only legally record your calls without the called party or the party calling you knowing you are recording them. Now here's the part most people screw up on, you can not legally record anyone else's calls from your phone without them knowing they are being recorded (**see the bottom of the last paragraph). The calling or called party to your number never needs to know they are being recorded so long as you are making or receiving the call yourself. So here's how this need to happen, you keep getting BS phone calls, so you tell everyone in the house that the calls are being recorded inbound and out bound so they all know (if what they want to talk about is private use a cell phone or a pay phone).

Businesses will record customer service lines and some internal lines to maintain service quality levels and ensure thing are done according to the companies policies. That is why you hear the message about recording for call accuracy, that is you notification that the call is recorded and a log is kept of your communications, so if the agent pisses you off remember it's on digital tape so stay cool and ask for a supervisor.

Now wire tapping is another ball of wax all together, legal request needs to be granted by a judge in writing to allow for the interception of private communications from a target residence or business. No interception can be done without a legal letter of authorisation being obtained and is only valid for the specified time period noted on the letter of authority. Every year a report must be file showing the justice department who was tapped by who's authority and for how long. Law enforcement and some government agencies must have a valid legal reason for intercepting your communication and prove they had a lawful reason to do so. **The public can not tap the phones of other people, that's just up front jail time with no excuses or deals.
