Specific bad check laws vary by state.
In almost all it is a crime, and depending on the amount (and circumstances) and place, even a felony. It can also be pursued as fraud or theft by deception...which is a felony crime almost everywhere.
In California, you can be held liable for the amount of the check plus treble damages not to exceed $500. Many other States have similar laws, again the severity of the punitive recovery, on top of the amount of the check, can relate to the amount of the bad check...and the actual circumstances. (Which is to say, an accidental overdraft, especially one quickly corrected, infrequently has legal repercussions...one written on a closed account, or where there is and was no intent to pay is taken seriously).
And rightfully so: Two people enter a store, one keeps the clerk occupied as the other empties the register, or grabs stuff and leaves. Or someone enters a jewelry store, threatens the clerk, empties the cases and runs. Or makes a selection, goes to the register and takes a gun out of his pocket and says I won't shoot you if you allow me not to pay..etc.
Same as above, but the someone goes to the register and pulls a bad check out of his checkbook.....really whats the difference?
States enact laws that relate to such matters so an exact answer cannot be given without knowing the state where the incident occurred and the history of the individual who took the action. The intentional act of writing a check which the person knows is not valid due to insufficient funds, closed account etc. in the majority of instances is a felony, the classification of the felony depends upon the dollar amount, the number of checks written, etc. Additional charges would also be made if the checks were stolen or used without permission of the account holder.
Writing a bad check is a crime. You are not supposed to write a check that cannot be cashed. You must write a check only when you have a corresponding bank account and have enough money in that account to pay for the check. If that is not the case then your check is termed bad and you are liable to be prosecuted/jailed/fined for doing so. The rule is the same in all countries/states and Colorado is no different.
my check bounced. the amount of the check was paid. i still need to pay the $25 to. Who do I pay that to?
The law for writing bad checks in Kentucky will depend on whether the check is a misdemeanor or felony. Any bad check can result in a jail time and probation.
