"You can be 10 years old and drink in Virginia," said Beth Straeten, a spokeswoman for the state's Department of Alcoholic Beverage Control.
At a time when some in the community are ex- amining the role of alcohol in the wake of traffic deaths, injuries and broken futures, Virginia remains one of the many states whose laws specifically tolerate a parent providing alcohol to an underage person. Eleven states, Virginia among them, say providing alcohol to an underage son or daughter can only occur in the home. Twenty other states say parents can provide alcohol to their children anywhere.
The Virginia exception was passed during the 2006 legislature. It drew only two negative votes and won the signature of Gov. Timothy M. Kaine. Kaine's office declined to comment on the law last week. A spokesman for Attorney General Bob McDonnell also declined to comment.

It depends where you live in the world i.e US Yes, in all states a parent may allow a minor to consume Alcoholic Beverages at home in private not in a public place. UK, yes. Japan, no. Europe, most countries but the minimum age varies.
In the United States, it is illegal for anybody under the age of 21 to purchase or consume alcoholic beverages.
Some families let a child have a glass of wine with dinner. Otherwise, parents can get in trouble if someone tells the police.

If they do not have legal custody, no. In fact, the custodial parent should take this matter before the court with jurisdiction over the case. They should try to obtain a court order that the child not be served alcohol while in the "other parent''s" custody. Serving alcohol to a minor could constitute child endangerment in some jurisdictions and the parents who does so in liable for any resulting damages. Some states allow parents to serve alcohol to minors at home but in other states it would be a felony. You should consult with an attorney.
