I don't think it's got to do with how old and more to do with is the child mature enough? I was left at home on my own at the age of 6 but that's because I was a good girl and I was also taught right from wrong. Only you as the mom or dad will know that. There are some kids out there that are little terrors and some that are angels and the court system doesn't know that. At the end of the day I personally believe it's an individual choice based on pure trust for your child but make sure you teach her or him the stranger danger rules about the door and phone because I was abused over the phone by a sick and twisted man when I was younger. I suppose you learn and grown from situations you are put in. Hope this helps you or maybe not.LEGAL AGE There are very few states in the U.S. with legal minimum ages, but many state agencies have published guidelines. Georgia, Illiniois, Maryland and Oregon are a few of the states with very specific ages. Typically 8 year olds and over can be left at home for up to several hours (usually after school before a parent gets home from work).

12 years old appears to be the most common recommendation. http://www.latchkey-kids.com/latchkey-kids-age-limits.htm provides a state by state comparison.

There are very few states in the U.S. with legal minimum ages for children home alone, but many state agencies have published guidelines. Georgia, Illiniois, Maryland and Oregon are a few of the states with specific ages mentioned in their laws.

12 years of age appears to be the most common recommendation. Below in Related Links is an article entitled Home Alone Children Legal Age Limits which provides one guideline from a California agency representative who suggests that 8 year olds and over can be left at home for up to several hours (usually after school before a parent gets home from work). This site also provides a state by state comparison with references.

North Carolina laws don't address the question of when a child can babysit siblings. Allowing a child to babysit is left up to the parent's judgment to determine the child's maturity level and ability to supervise children and react accordingly in an emergency.

There is no law that specifically states. The basic rule is that the child must be safe and the child must feel safe. Most places would think that a child about 15 could be left alone over night. They also must know how to get help or assistance if there is a problem.

NC General Statutes

§ 14-318. Exposing children to fire.

If any person shall leave any child under the age of eight years locked or otherwise confined in any dwelling, building or enclosure, and go away from such dwelling, building or enclosure without leaving some person of the age of discretion in charge of the same, so as to expose the child to danger by fire, the person so offending shall be guilty of a Class 1 misdemeanor.

I learned of the above statute by calling Child Protective Services (CPS) of Wake County, NC. CPS also said they consider it to be neglect for a child under 10 to be left home alone, and sometimes at 10-11 depending on the child, and the courts have backed them. ---------------------------------------------------------------------------------------------------

According to the NC Department of Health and Human Services: What is the legal age when a child may be left home alone? There is no age specified by law that a child can be left alone in North Carolina. Parents and caretakers must look at the child's maturity, the safety of the community, and access to emergency assistance. A child may be mature enough to stay alone, but not to care for younger siblings. If you are concerned that a child is left alone and is unsafe, call your county department of social services.

When can a child with Asperger's Syndrome be alone overnight?

That would depend on the child's ability to care for himself or herself, it's just the same as leaving any other child alone for the night, if he or she in intelligent enough to care for him or herself then it's fine. I wouldn't recommend leaving a child at a young age alone for the night though no matter whether they did or didn't have the condition.
