They can take your entire paycheck. Then, you have to talk to them and make arrangements to pay. They sometimes give you back part of your check - but they don't have to. It's better to send them small payments. When they cash your check it proves that you were trying to pay. This might prevent them from garnishing your check.

Can your check be garnished to pay a medical bill if you only work part-time?

Maybe. Federal or state law determines the percentage of wage garnishment. Under federal law the maximum garnishment is 25% or 30 x minimum wage/$382.50 with the first $217.50 of disposable income being exempt. If the state where the garnishee resides has a garnishment percentage less than the federal allowance, (many do), that will be the maximum amount subject to garnishment.

What would qualify as a hardship defense to stop wage garnishment?

The law does not recognize "hardship" as a valid defense against the execution of a judgment writ in any manner including income garnishment. The judgment debtor/garnishee can file a motion requesting the lowering of a garnishment amount due to the fact that it constitutes a 'hardship' upon themselves and/or their immediate family. An example would be the maximum garnishment (25% of disposable income) granted against the head of household that results in she or he being unable to properly clothe, feed, house, provide medical care, etc. for his or her dependents.

In the state of Mississippi can wages be garnished for unpaid medical bills?

Yes, a lawsuit judgment can be executed as a wage garnishment. Wage garnishment for creditor debt is possible in all states with the exception of North Carolina, South Carolina, Pennsylvania and Texas (with certain exceptions). Before wages can be garnished the creditor must file a lawsuit in the appropriate state court where the debtor lives. If the creditor prevails in the suit a judgment will be entered against the debtor, and the judgment creditor can then execute it as a wage garnishment. Federal law allows for a maximum of 25% of disposable income to be garnished, with the first $154.50 (weekly based) being exempt. Some states have established there own garnishment laws and percentages. If the state's percentage is lower than the federal the state is the one that is used. No. Only child support and unpaid taxes may be unvoluntary taken from your pay check. * Yes. The issue of child support and tax arrearages only pertains to exempted income such as Social Security benefits. Mississippi allows a judgment creditor to execute said judgment as a wage garnishment.

How can you stop student loan garnishment if it will cause extreme hardship on your family?

*************************** From student loan GUY at www.studentloanfundamentals.com You can surely challenge the garnishment IF it is causing financial hardship... Here is how to stop the garnishment: Financial Hardship: You can challenge the garnishment by submitting what is called a "financial statement". Along side with the financial statement you would want to submit all of your bills and expenses. (Remember they consider credit cards, Timeshares, and such as luxuries) If you have medical bills or medical problems make sure that you include proof of this... Non-Financial Hardship: Negotiate a minimum payment that is a qualifying amount for the "Rehabilitation payment program". This is going to sound silly but hear me out.... MAKE PAYMENT ON TOP OF THE GARNISHMENT.... after 9 months your garnishment will cease and you will have most of your collection fees waived... Best of Luck... Mr. K Rogue student loan collector
