In a nutshell - Because neither the framers of the United States Constitution nor any subsequent Congress has deemed it appropriate to pass a bill declaring an official language of the United States. By and large, the adoption of an "official" language has been seen as antithetical to the concept of equal rights and justice under the law embodied in the U.S. Constitution.

This author's personal opinion is that there is decidely something un-Democratic and probably unconstitutional about creating a law that restricts both freedom of speech and a person's ability to adequately communicate. Like 1920's Prohibition or the legitimization of slavery in past decades, it would make criminals out of law-abiding and decent people, and it would be doomed to ultimate failure. Congressional representatives of all parties have recognized this and saw the wisdom of just letting be.

Do I think people in the U.S. should learn English? Yes, I do. Do I think it should be mandated by law? Absolutely not.

Although English is the most common language spoken in the United States, is the country's common language, and is the language which all laws and our Constitution are written in, the United States actually has no official language.

The founding fathers did not declare a national language in the U.S. Constitution (although they debated this issue), and the United States Congress has repeatedly failed to pass legislation that would declare a national language because of pressure by lobbying groups and fear of discrimination by minority groups who do not speak English as their primary language. Legislation to declare English our national language is one of the most commonly presented bills in Congress, but has never passed both chambers of Congress, which is required to become a law.

Many states, on the other hand, have declared an official language:

English is official in 31 states. Hawaiian is official in 1 state. Both French and Spanish share similar statuses in some states, however, they are not official in any state. The town of El Cenizo, Texas has declared it's official language as Spanish, making it the first community in the country to favor Spanish over English.

The United States has no legally mandated language at a federal level, but all governmental agencies are conducted in English at the highest levels and English is by far the most common language in the United States.

Over half of the states (31/50) have made English the official language of those states.
