Doctors are required by law to disclose any activity which is directly harmful to the child. If a doctor knows that the child has a sexually transmitted disease, he must report it because sex with children is illegal and harmful.

No. When I was called for jury duty, I knew the attorney, prosecutor, the judge and knew about the case. I still had to report, but was eventually dismissed. Ridiculous.

Duty of confidentiality imposed by law on doctor?

If the doc tells anybody anything about you.... that is MALPRACTICE for which you can sue his butt (unless you give him/her permission as when you are referred to another doc). One of the reasons we go to ANY doc is because we trust them. That includes maintaining confidentiality. If there is evidence of a crime such as a bullet wound, sexual abuse, abuse of a child or any crime, the law protects the person or child or anybody who is a victim. in these cases the law states the doc MUST report it. Since it is required by law he/she is protecting the victim and can not be sued.Another View: The ethics of the AMA (American Medical Association) and the doctors profession impose an ETHICAL code of silence on him - The LAW respects and acknowledges this ETHICAL practice but the doctor's "code of confidentiality," is NOT necessarily codifed in the law in all jurisdictions. Also, as mentioned in the previous answer, there are many exceptions to it. ADDITIONALLY: Within recent times the 'Health Information Privacy and Portability Act' (HIPPA) places further restrictions on medical practitioners and medical facilities.

What does capacity in tort mean?

Capacity means the mental capacity to recognize having a duty of care and knowing how not to breech it. For example if a young child accidentally hurts a playmate, the child cannot be sued for negligence, because the child lacks the mental capacity to know whether or not what he is doing is negligent.

By reporting it to the agency in charge of child services in your state of residence or law enforcement depending on the law where you reside. This is not something that should be done lightly. False accusations of abuse have lead to both parents losing custody to the state. However if the child is really being abused, you have a duty to report it.

Can a police officer get in trouble for dating a girl who has warrants for her arrest and doesn't arrest her if he knows this?

An educated guess: Yes, an officer has an obligation to report crimes or arrest fugitives of which he has knowledge, unlike an average citizen. If you or anyone is connected to the crime (accessory or helping hide a crime, such as harboring a fugitive or obstructing justice) or have a mandatory duty to report certain offenses (e.g., child care provider or teacher who knows of child abuse), that's different.

What is The philosophy that justifies state intervention in the lives of children when their parents are unable or unwilling to protect them?

When parents don't provide or protect their children this is child abuse and the state has the duty to make sure the children are taken care of because they are unable to do so themselves. Since the early 1900's society has felt that the care of children is vital and important duty even though child abuse laws were not written until the 1960's.
