The Tenth Amendment assigns the state governments their powers by stating, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." This amendment means the states have the right to pass laws that promote the welfare of their citizens.
The Tenth Amendment reserves to the states respectively, or to the people, all powers and rights not delegated to the Federal government by the Constitution [so long as these powers or rights are not prohibited to the states by the Constitution. eg. dormant commerce clause.]
How this principle is applied depends on whether the US can be shown to be applying laws and rules that would contravene these rights, i.e. exceeding the mandate of the Constitution.

Persons who are not attorneys often conclude that the 10th Amendment is a very powerful check against the federal government. However, this is a common misunderstanding. For more information, please read the additional notes on the discussion page.
The Tenth Amendment was ratified in 1791 as the last part of the Bill of Rights, and is intended to protect state sovereignty and (to an extent) individual rights from being usurped by the Federal government. The wording is so vague, however, that the Supreme Court virtually declared it useless in United States v. Sprague, (1931).
"The Tenth Amendment added nothing to the Constitution as originally ratified, and lends no support to the contention that the people did not delegate this power to Congress in matters affecting their own personal liberty."
Amendment X
"The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."
Translated, this means:
The states have power to regulate anything not assigned to the federal government or specifically withheld from the states by the Constitution (these are listed in Article I, Section 10). Whatever powers aren't claimed by the federal or state governments are leftover for the people.

The 9th Amendment to the Constitution limits the powers of the government to constrict the rights of the people. This means that the people have other rights besides what is written in the wording of the Constitution. The 10th Amendment says that the government has rights that are also not written into the Constitution.
