Even when 'state's rights' is brought up, the issue of state's rights is always couched in terms of the state's right to maintain the institution of slavery

<a class="h2heading h2" style="color: rgb(0, 0, 0);" name=" "> </a> If you would even look at a history book, it would tell you that slavery was not an issue until Lincoln signed the emancipation proclamation in the middle of the war. and that was to keep England and France out of the war. The main reason for the war being started was not enough representation in congress or the senate.

the civil war was started by a number of reasons, all of which stemmed from slavery.

In 1828 the tariff was unusually high, passed by Adams during the last few months of his term. Called the Tariff of Abominations by irate Southerners, it was widely hated and with the passing of the Tariff of 1832, things did not seem to be looking up for the Southerners. They thought that it discriminated against them; for all the manufacturing capacities in the North, the South had very little factories of it's own. Southerners bought expensive manufactured goods from the north but had to sell their own raw goods in a protected home market, thereby diminishing their ability to make good profits. The tariff sparked regional boycotts and refusal to comply with the "black tariff" South Carolina even threatened to secede from the Union if the government attempted to collect the tariff by force. Eventually Jackson, annoyed at the lack of authority that he seemed to assume in South Carolina and their threats, promised to send in troops if South Carolina refused to pay the tariff. However, crises was averted after the Tariff of 1833 was passed, called the Compromise Tariff which lowered the rates and was passed to please the Southerners.

The Compromise of 1850 showed the increasing tensions between the North and the South. After California was admitted as a state without the formal waiting period in 1849, shortly after the '49 Gold Rush, the South was made, at last, the minority in the Senate. The Compromise of 1850 settled the issue of California as well as many others. For the last time great debators and compromisers like Clay, Calhoun and Webster gathered together. The Compromise was designed to keep both regions happy; the North enacted a harsher Fugitive Slave Law to crack down upon the run away slaves under systems like the Underground Railroad, a law which was violently opposed by the Northerners. It forbid people from housing escaped slaves and slaves were tried without jury and judges were always bribed to convict the runaways. Northerners were fined or jailed for helping slaves and were required to assist slave hunters if asked. Naturally this caused even more widespread hatred of the South and supporters of anti-slavery.

Also very important was the Kansas Nebraska Act, proposed by Stephen Douglas. Because states like California and Oregon were so far away from DC and the government, many congressmen lobbied for a transcontinental railroad to facilitate relations. However, as a Chicago politician, he wanted the Eastern terminal to pass through the north. Naturally any bill to help the North was immediately killed by the Southern congressmen. To appease both sides and get the railroad, which would promise increased population, wealth and influence, he settled that they would settle the previously formally uninhabited Nebraska territory, but split it into two states, Kansas and Nebraska which would decide on the issue of slavery by the policy of popular sovereignty, meaning each state would have formal elections to decide for themselves. Kansas, which would share a southern border with Missouri, a slave state after the famed Missouri Compromise of 1820, would be slave and Nebraska, as close to free Iowa, would be free as well. This scheme was backed heavily by the South, although apposed by the North. The Kansas Nebraska Act would go against the Missouri Compromise, which promised no slavery, with the exception of Missouri, above Missouri's southern border. Northerners thought Douglas was too impetuous and did not care about the issue of slavery or his fellow Northerner's feelings about slavery. After much heated debate the Kansas Nebraska Act was passed in 1854.

As a reaction to Kansas Nebraska Act, when Kansas was finally settled, the New England Emigrant Aid Company, sponosred by the Free Soil party, in turn sponsored the population of Kansas with people with anti slavery views. the Southerners, outraged at the thinly veiled attempts of the North to steal away their state, sent in people from Missouri to vote early and often at the polls to vote in the Congressional elections. Refusing to recognize the fradulent government, the free soilers set up their own and the federal government was forced to choose between a fake government and an illegal one. Fighting soon broke out between the free soilers and the slaveryites, the first signes of the Civil War.
