Neither make any difference for both are symbolic of his death. This writer believes in a living Christ and not a dead one. To some the cross reminds them of His death and sacrifice.
Yes some did regret to put ''Jesus'' on the cross
We are not told where Caiaphas was during the Crucifixion of Jesus. Matthew 27:41 tells us that some of the chief priests were there at the cross mocking Jesus. Perhaps (but we don't know) Caiaphas was among them.

death
The empty cross represents the Resurrection, for after Jesus died and was removed from the cross leaving an empty cross. He arose after 3 days.
Consequences? There are none. Through his Son, Jesus Christ, God provides the hope of a resurrection for sinful mankind. (John 5:28, 29; Acts 24:15) Why? Because Jehovah is love. (1 John 4:8) When he allowed his Son to die a shameful death, God was actually manifesting his marvelous quality of love. Sometime before, Jesus had said: "God loved the world [mankind] so much that he gave his only-begotten Son, in order that everyone exercising faith in him might not be destroyed but have everlasting life." (John 3:16)
To symbolize that Christ died for our sins and rose again as well as the fact that He died on the cross.Roman Catholic AnswerThe Church requires that there be a Crucifix (a cross with a corpus {Christ's Body} on it) to celebrate Mass which is the re-presentation of Our Blessed Lord's Sacrifice on Cross. Please note, that although Easter proved Our Blessed Lord's victory over sin and death, it was His Death that actually accomplished our salvation; and it is His Death that gives us the grace (through Holy Communion) of following in His Footsteps.
Yes He did die on the cross for real. He lost lots of blood from the whippings He got with the cat-o-nine tails. After that He was nailed to the cross for hours where he bled to death from the nails in His hands and feet. A final assurance of His death on the cross was when they drove a spear into His heart to make sure He was dead. If anything, the spear confirms His death on the cross.
