In May 2009, the Indiana Court of Appeals vacated his sentence, reduced it from 72 to 36 years, and remanded the case to the trial court for disposition.
The Court of Appeals conclusion states:
"Based on the foregoing, we conclude that the trial court did not abuse its discretion when it failed to enter a written sentencing statement. However, we find Ellis‟ sentence inappropriate pursuant to Appellate Rule 7(B) and therefore vacate the trial court's sentence and remand with instructions to enter sentence as provided herein.
Vacated and remanded with instructions."
If Ellis continues to appeal the case, he still has several steps to take before he would be eligible to petition the US Supreme Court.
