If you are NOT an employee, but rather a business-owner -- who needs to provide coverage -- the answer to this depends on what state you are in. Some states, e.g., Ohio, are "exclusive fund" states. If you do not live in an "exclusive fund" state, there will still be a "state fund" in place. You can purchase your coverage there, or from any private carriers that offer WC coverage in your state. You should check with the agent/broker who handles the rest of your business insurance.

It is extremely important that you deal with an "authorized insurer", meaning one that has the requisite authority to conduct business in the State(s) in which you do business and in which you must provide insurance. Because worker's compensation insurance serves the purpose of shielding your business from most individual liability for work-related claims, the failure to do business with an authorized insurer can leave your business individually exposed to worker injury claims. You should contact the Department of Insurance of your State for confirmation that the insurer that you are considering is authorized to transact worker's compensation insurance business.

All laws pertaining to workman's compensation insurance are inacted and enforced by the resident state. It would be necessary to contact the states labor relations board to find out the procedure for obtaining such coverage.

An alternative available in most states for certain workers is Occupational Accident and Contingent Liability. When paired together, they can provide many of the same protections, and in some cases can be better. The best fits for this option are volunteers and self employed, subcontracted workers.

As an aside, I don't disagree with the original answer. However, if a worker lives in one state, is employed by a company in another state, and travels on business to a third state where an accident occurs, he has a choice under which state to make his claim under Workers Comp.

The Workmens Compensation claim is customarily opened by those in charge of administrating the policy at the place where you work. This may be "The Boss", a Benefits Coordinator, a Supervisor, or someone in the H.R. office. The beginning of your claim starts with an accident report, and is followed by a report by those commissioned with the duty to do an investigation at the jobsite, usually an "Accident Investigation Team" or similar entity. This constitutes the "opening" of your claim. Note: Your Employer is required to post certain fact sheets in public places where they can be seen, by law; and, Workmens Comp. information is included in this type of posting, along with what concerns discrimination, EEOP, and so forth. The Employer is NOT required to lead you by the hand through anything. This leaves the door open for unscrupulous agents of the employer to deliberately keep their "helpfulness" to a minimum in an unpublicized effort to minimize an employer's liabilities. If it is not mandatory for an employer's agent to tell you something which might help you in this process, and telling you might incur a perceived increase in liability upon the employer, then chances are that you won't hear it from them. If it is required by law that they tell you something, or that they proceed in a certain way to protect your rights, then such things are adhered to TO THE LETTER--- and NO further... It is important for you to DOCUMENT EVERYTHING, since what the employer documents is for their benefit and records-- not yours... An employer has three concentrations of focus when it comes to Workmens Compensation claims: 1) The Law 2) Liability 3) Your Welfare The order in which they are listed is the order in which they are prioritized. Workmens Compensation Insurance was put into effect to protect the worker. It needs to be understood that the entity from whom the worker is being protected is the employer; and, a small amount of wisdom is applicable in such a case: "Remember--- The 'Friend' to whom you speak may not be your Friend at all..."

The short answer is... you probably won't be able to find it, ever. There is simply not enough premium collected from a short-term workers comp policy for an insurer to want to accept the potential cost of employee injury claims. To make this more meaningful consider this... your workers compensation policy has no specified maximum limit of coverage (don't confuse the employers liability or part II coverage) except for the settlement amounts and conditions specified by your states industrial insurance laws. The potential payouts are astronomical and can last for decades.

That being said, there are types of aggregated policies, such as OCIP's, that include workers compensation as part of the entire portfolio of coverage, for one large construction project. But the premiums for these types of policies are often in the MILLIONS.

right now I have just 'finished or ended' my workmans comp, so in answer to your question the best i can: in my case, I had to see an 'agreed medical examiner' (AME), at which time he will either recommend more time off, surgerey or occupational rehab. (in some cases all three). when those things are complete, you will be asked again to see the ame, and he will declare you 'permanent and stationary' which basically means that you'll get no better or no worse, then u will most likely start 'vocational rehab'. Once a person is pns(permanent and stationary)your temp. disability payments will decrease. this marks the 'end' of workmans comp per se, but you still have to go through any re training ordered, upon completion, you and the employers insurace should reach some kind of settlement agreement(if you don't have an attorney)
