Actually it's just the president of European Union at the time see Herman Van Rompay might be in charge now but in six months it will change so don't just say he's in compleate charge because trust me he won't be in a couple months.
Normally, the European Comission holds the right of initiative which means it can propose laws to the European Parliament and the Council of the European Union (not to be confused with the Council of Europe or the European Council). Then both institutions will amend the proposed law in order to reach an agreement. If they won't agree on the proposed law and its amendments, there will be no 'law'.
