Who should be responsible for a car accident occured during a test drive if the potential buyer hits a stationary subject and damaged the car?

[Edit]

Answer

I would say who ever was driving the car. But it depends on what the highway patrol, insurance company and the judge says if it goes to court.

How old must you be to test drive a new car?  Who is responsible for an accident during a test drive?  Should you make someone sign your car out for a test drive?  Am you responsible if someone uses your car and has an accident?  A potential car buyer and you agreed that you would sell him the car is this legal and binding?
