Just Black dissented because of his absolutist belief that Congress shall make "no law" abridging the freedom of speech, and probably because of a similarly absolute view on the constitutional mandate of a "public" trial under the Sixth Amendment.

He did not believe that the Constitution provides the right to a "fair trial" above the provisions in the Bill of Rights.
