You just do it. You can identify yourself with a style, which is what makes this artform so amazing. Everyone who does it brings something new to it. If you are going out to tag, make sure you don't work somebody else's neighborhood. It's disrespectful. Do not tag over a tag. Also, you don't just start tagging if you're not fast or creative enough. Practice at home on cardboard and get to know what you can do with a can. I would assume so. It is considered destruction of property.... unless of course it is your own property and you don't mind it. Graffiti is illegal in most states and countries, but it depends on what kind of graffiti. For example, reverse graffiti causes police to be baffled on it's legal state. This is because reverse graffiti is created by washing dirt off of a wall, instead of adding on to it with a spray can. Also, the famous but mysterious graffitist Bansky is known for his graffiti which brings a world image and causes you to think. Bansky and related art is legal and sometimes even encouraged in some states.

What time of day should you do graffiti?
Graffiti on public buildings, walls and so on - in fact, in any area that can be viewed by the public, is illegal and rightly so, as so much is unsightly, it can be offensive, and it costs a great deal of money to clean up - money that could be better spent on more productive or important things. If you must express yourself through 'art' then why not take up painting properly - join an art class or simply set up on your own, and if some of your work is sold (local art fairs/ eBay) you could end up having a very enjoyable hobby, give many people a great deal of pleasure rather than offense, and earn quite a bit of money for yourself too.
