The only way the App Store could not be on your iPod Touch is if you have a jailbroken iPod and it was deleted. The App Store is an app that cannot be deleted on a non-jailbroken iPod Touch. Restoring the iPod Touch should fix that. You will loose your jailbreak by restoring however.
It is also possible that you have 'Restrictions' enabled and the App Store is restricted. To fix this, you have to go to go to Settings >>> General >>> Restrictions. Then you enter the four digit restriction pass-code and then you can turn the restriction off. NOTE: This works on Jailbroken devices and normal devices. Unless your jailbreak has in retrospect, taken over your iPod Touch and locked you out of it or corrupted it. To use safer jailbreaks, stick with the top three jailbreaks; GreenPois0n, RedSn0w, and JailBreakMe.com. Again, these are not completely safe, as no jailbreak is safe, but those are the top rated for safety and ease.
