In Minnesota the alone case of being high on ANYTHING is not a crime. There are aggravating factors (penalty enhancers) in play that can however make it a crime.

For instance, you find it upon yourself to shoot up a syringe of heroin and shortly thereafter you relax on your porch after having properly disposing of the needle while ensuring there isn't a testable quantity of the narcotic left over. Say Officer Friendly stops by your porch just to say hi and he notices you're higher than a kite, you can openly and blatantly admit guilt of you having just shot up and being high. As long as you are not a danger to anyone else's civil rights, he will tell you to have a nice day.

In Minnesota, it is illegal to possess any contraband or controlled substances recognized by state statute as illegal. It is not illegal however to simply be high after consuming said controlled substances.

Aggravating factors include:

Driving under the influence of a controlled substance (including alcohol)

Consuming narcotics within proximity of a minor

consuming narcotics within a school zone

just to name a few.

Being high can also be an aggravating factor for other crimes such as assault, murder, etc.

Marijuana specifically has undergone a decriminalization of sorts in the past few years. Possession of a quantity less than 42.5G is a misdemeanor crime punishable by a $200 fine and/or a Drug informational class (used to be a $1000 fine and or 90 days in jail)

Any possession above 42.5G is considered a Felony and there are varying degrees depending on the quantity. Again there are aggravating factors on that scale as well.

The sale, manufacturing (growing), and trafficking of Marijuana (not trafficking if there is less than 42.5g in the trunk) is considered a felony at any quantity and again there are varying degrees based on how much you have in your possession.
