Best Answer

No. Godparents are not recognized as having the legal status to petition the court for visitation rights to minor children. That being the case, visitation of minor children would only be possible if the custodial parents voluntarily allowed it.

Can an unwed mother in the state of Ohio pursue visitation rights against the father?

Once the father's paternity has been established in court she has to be able to prove he is unfit or the court will allow him his rights. If she refuses even though there is a visitation order she would be in contempt of a court order and could eventually lose custody if she continues to interfere with his visits.

What are the rights of a birth parent once she relinquishes their custody to a child?

That depends on the circumstances of the custody modification. Was it permanent, temporary, was the child adopted, did the parent voluntarily relinquish parental rights or were they terminated by the court? No one here can possibly give you an answer without a lot of detailed information including your legal residence. You should really consult an attorney anyway. He or she would be able to provide an informed and detailed opinion on whether or not you have any rights and if so, what they are.

Are the godparents the new parents in case both parents die?

Technically, no, not legally. Godparents take a religious oath to help in rearing a child in religious ways. But when both parents die, godparents are under no legal obligation to assume the daily care of children. Plus, legally, the godparents may not be able to become caregivers. They may be ill, too old, or have other problems that would make godparents unable to care for children.

Does a 17 year old have to visit father in a joint parenting plan that requires visitation rights for the father?

If the court order says the father has visitation rights, then the father has visitation rights and what the 17 year old thinks about it doesn't legally matter any more than the 17 year old would be able to get a court to find him not guilty of stealing something on the grounds that he really, really wanted it and couldn't pay for it.So, yes. The 17 year old has to visit the father. The court can't require him to be happy about it, but they can require him to do it.

What if father finds out he is not the biological father and the real father wants to take rights and I am with neither?

This varies from state to state. step 1 for the bio father would be to sue for paternity; if he does so, he will establish his parental rights and may be responsible for child support as well as have visitation rights, or even be able to sue for custody.

Can legal guardian deny vistitation rights to biological parents?

In certain circumstances, a legal guardian may be able to deny visitation rights to biological parents if it is deemed to be in the best interests of the child. This typically occurs if there is evidence of abuse, neglect, or if it is determined that visitation would be harmful to the child. However, it ultimately depends on the laws of the specific jurisdiction and the decisions made by the courts.

Would I have any rights to my half sister to be able to see her even though her mother wont let me. my dad no longer lives here?

If you are a minor, no, not without court intervention. If your dad would agree and providing his parental rights haven't been terminated, he could petition the court on your behalf for modification to the visitation order asking for you to have visitation rights or you could write a letter to the judge with jurisdiction asking for permission, but it would be up to the judge to determine whether doing so would be in the child's best interests. The mother also has the option of objecting to such a modification. Ultimately, it would be up to the judge should that occur.

Will you be able to receive custody or visitation rights of children if you owe child support?

Of course you can. Just because you owe money does not mean any one has the right to keep you from your child. Even if you owe the money to the state. If you are not receiving your visitation rights that have been decreed in the court of law then you need to go back to court and make the courts enforce the order on your ex.
