The legal ramifications of Certified Mail (and other service of legal notice) vary from state to state. Under some state laws (notably Louisiana), refusal of Certified Mail can be legally cited as a waiver of knowledge of legal action. Such an attempt to notify a party may be grounds for the continuation of a legal process in absentia, and may result in a default judgment. This is normally done by governmental bodies, who are also required to legally publish such results. Some states, including Florida, file small claims notices by Certified Mail, but only for defendants who are state residents. Some cases require physical delivery of notices.
