It depends on the states child support laws and what is written in the child support order. But if the non-custodial paying has failed to pay when order was written all that time...well like I said...it's time to pay up.

If you have a court ordered agreement then I know in Missouri the state will garnish wages or tax refunds to begin to recoup some of the money. However if you have not received a child support agreement and you want to then you have to go in to the state and request for a child support hearing. Missouri does not usually require back child support to be paid, it is from the date of the final court hearing in determining the correct paternity.
