You were reversing out of a parking space a child opened the back door of the car to the left and got her leg trapped btween their car door and their car and also scratched your car who is at faul? |
[Edit] |
Answer
The car to the left is at fault, because as the person was reversing the child opened the door, the parents of the child in the car to the left should have seen that you were reversing and told the child to keep the door shut. It is also the car to the left's fault that your car is scratched because if they hadn't opened the door then the car wouldn't have been scratched.
So overall it is the person in the car on the left's fault not yours.
I hope i helped x
parking lots rules
well a driver backing out of any place is or could be held responsibile for all damages ,but as the child in a car and care of the parents or gauridant would have to take some responisbile for said damage ,with the courts who knows what would happen ,i would expect the out come to be in faviour off the driver backing out or it may go 50%--/50%to both its hard in the place of a parking lot as some rules of the road dont appllyas if back out of a drive way you would be liaibile for all damages but as we went throught a case some one like this iwe found not all laws apply in a parking area or structer.
