Does the non custodial still have to pay in the summer if the child is with him for four weeks?

I am a non custodial parent and I am trying to get my kids for the summer as it states on my divorce papers. My lawyer just told me yes you do have to pay but your payment will be cut like an half cause the custodial parent still has bills to pay reguardless if child is there or not. There is some paper work you have to fill out and send into child support. I dont know what the form is call child support ofc and ask them. My lawyer is sending mine. Good luck It depends on the language of the court order.

Don't ask for it. This is a cause for future problems. The parent could move to another state, than file a retroactive order, claiming fear of abuse for dismissing the previous order.

Does a father have to pay child support for a child that is 18 and still in high school?

The issue of there being no court order of support does not relieve a parent of their financial responsibility. In such a situation the parent paying the support could cease payment once the child reaches the state's age of majority, which in NY is 18. More importantly, the parent who is voluntarily paying support needs to be certain all monies tendered for the child is documented in the form of a cancelled check, money order made out to the custodial parent or some other form that can be validated...NOT CASH! The check or whatever should state specifically that the money is for the support of the minor child. If this is not done, there is nothing to prevent the custodial parent from filing a court order claiming that no support has been rendered. Such action would cause the non-custodial parent in serious legal problems, which would be expensive to say the least. A safer and more acceptable option for all parties involved would be to obtain a court order of a specified amount of support and time.

Can a child be declared emancipated if they decline to continue a relationship with their non-custodial parent?

No. Child Support has nothing to do with relationship. However, I you could file a court motion to determine the cause of not wanting a relationship and determined if the custodial parent/family/friends are promoting parental alienation towards the non-custodial parent.

What causes a baby to come out deformed?

Mutations in their chromosomal DNA. Each parent gives chromosomes to the baby, and when they meet sometimes there are doubles of chromosomes, missing chromosomes, or mutated chromosomes which cause abnormalities in the DNA and overall the child.

Can a mother take her children to another state with out father's permission if not married and he does not pay child support and she is the breadwinner?

What does your court order say about moving out of state? Does the non-custodial parent take part in visitation with the child? How screwed up do you want the child support to become? The adult way to handle this is to have a conversation with the other parent and let them know your intentions, why you are moving and the impact this will have on visitation. If the other parent visits regularly the order will have to be rewritten (if the other parent wants it to be) to allow for travel, how is the child going to get back and forth, how much time will be spent with the other parent, etc.
